\u300eIf, as Mark Twain reput\u00aded\u00adly said, his\u00adto\u00adry often rhymes, our era increas\u00ading\u00adly recalls the peri\u00adod pre\u00adced\u00ading 1914. And as with Europe\u2019s great pow\u00aders back then, the Unit\u00aded States, led by an admin\u00adis\u00adtra\u00adtion intent on assert\u00ading America\u2019s dom\u00adi\u00adnance over Chi\u00adna, is push\u00ading the world toward dis\u00adas\u00adter.<\/span><\/span><\/p>\n

The con\u00adtext of the arrest of Huawei CFO Meng Wanzhou \u2013 a dan\u00adger\u00adous move by U.S. Pres\u00adi\u00addent Don\u00adald Trump\u2019s admin\u00adis\u00adtra\u00adtion in its inten\u00adsi\u00adfy\u00ading con\u00adflict with Chi\u00adna \u2013 mat\u00adters enor\u00admous\u00adly. The Unit\u00aded States request\u00aded that Cana\u00adda arrest Ms. Meng in the Van\u00adcou\u00adver air\u00adport en route to Mex\u00adi\u00adco from Hong Kong, and then extra\u00addite her to the Unit\u00aded States. Such a move is almost a U.S. dec\u00adla\u00adra\u00adtion of war on China\u2019s busi\u00adness com\u00admu\u00adni\u00adty. Near\u00adly unprece\u00addent\u00aded, it puts Amer\u00adi\u00adcan busi\u00adness peo\u00adple trav\u00adel\u00adling abroad at much greater risk of such actions by oth\u00ader coun\u00adtries.<\/span><\/p>\n

The Unit\u00aded States rarely arrests senior busi\u00adness peo\u00adple, U.S. or for\u00adeign, for alleged crimes com\u00admit\u00adted by their com\u00adpa\u00adnies. Cor\u00adpo\u00adrate man\u00adagers are usu\u00adal\u00adly arrest\u00aded for their alleged per\u00adson\u00adal crimes (such as embez\u00adzle\u00adment, bribery or vio\u00adlence) rather than their company\u2019s alleged malfea\u00adsance. Yes, cor\u00adpo\u00adrate man\u00adagers should be held to account for their company\u2019s malfea\u00adsance, up to and includ\u00ading crim\u00adi\u00adnal charges, but to start this prac\u00adtice with a lead\u00ading Chi\u00adnese busi\u00adness per\u00adson \u2013 rather than the dozens of cul\u00adpa\u00adble U.S. CEOs and CFOs \u2013 is a stun\u00adning provo\u00adca\u00adtion to the Chi\u00adnese gov\u00adern\u00adment, busi\u00adness com\u00admu\u00adni\u00adty and pub\u00adlic.<\/span><\/p>\n

Ms. Meng is charged with vio\u00adlat\u00ading U.S. sanc\u00adtions on Iran. Yet, con\u00adsid\u00ader her arrest in the con\u00adtext of the large num\u00adber of com\u00adpa\u00adnies, U.S. and non\u2011U.S., that have vio\u00adlat\u00aded America\u2019s sanc\u00adtions against Iran and oth\u00ader coun\u00adtries. In 2011, for exam\u00adple, JP Mor\u00adgan Chase paid $88.3 mil\u00adlion in fines in 2011 for vio\u00adlat\u00ading U.S. sanc\u00adtions against Cuba, Iran and Sudan. Yet Jamie Dimon wasn\u2019t grabbed off a plane and whisked into cus\u00adtody.<\/span><\/p>\n

And JP Mor\u00adgan Chase was hard\u00adly alone in vio\u00adlat\u00ading U.S. sanc\u00adtions. Since 2010, the fol\u00adlow\u00ading major finan\u00adcial insti\u00adtu\u00adtions paid fines for such vio\u00adla\u00adtions: Ban\u00adco do Brasil, Bank of Amer\u00adi\u00adca, Bank of Guam, Bank of Moscow, Bank of Tokyo-Mit\u00adsubishi, Bar\u00adclays, BNP Paribas, Clearstream Bank\u00ading, Com\u00admerzbank, Com\u00adpass, Cr\u00e9dit Agri\u00adcole, Deutsche Bank, HSBC, ING, Inte\u00adsa San\u00adpao\u00adlo, Nation\u00adal Bank of Abu Dhabi, Nation\u00adal Bank of Pak\u00adistan, Pay\u00adPal, RBS (ABN Amro), Soci\u00e9t\u00e9 G\u00e9n\u00e9rale, Toron\u00adto-Domin\u00adion Bank, Trans Pacif\u00adic Nation\u00adal Bank (now known as Bea\u00adcon Busi\u00adness Bank), Stan\u00addard Char\u00adtered and Wells Far\u00adgo.<\/span><\/p>\n

None of the CEOs or CFOs of these sanc\u00adtion-bust\u00ading banks were arrest\u00aded and tak\u00aden into cus\u00adtody for these vio\u00adla\u00adtions. In all of these cas\u00ades, the cor\u00adpo\u00adra\u00adtion \u2013 rather than an indi\u00advid\u00adual man\u00adag\u00ader \u2013 was held account\u00adable. Nor were they held account\u00adable for the per\u00adva\u00adsive law\u00adbreak\u00ading in the lead-up to or after\u00admath of the 2008 finan\u00adcial cri\u00adsis, for which the banks paid a stag\u00adger\u00ading US$243 bil\u00adlion in fines, accord\u00ading to a recent tal\u00adly. In light of this record, Ms. Meng\u2019s arrest is a shock\u00ading break with prac\u00adtice. Yes, hold CEOs and CFOs account\u00adable \u2013 but start at home in order to avoid hypocrisy, self-inter\u00adest dis\u00adguised as high prin\u00adci\u00adple and the risk of incit\u00ading a new glob\u00adal con\u00adflict.<\/span><\/p>\n

Quite trans\u00adpar\u00adent\u00adly, the U.S. action against Ms. Meng real\u00adly seems to be part of the Trump administration\u2019s broad\u00ader attempt to under\u00admine China\u2019s econ\u00ado\u00admy by impos\u00ading tar\u00adiffs, clos\u00ading West\u00adern mar\u00adkets to Chi\u00adnese high-tech\u00adnol\u00ado\u00adgy exports and block\u00ading Chi\u00adnese pur\u00adchas\u00ades of U.S. and Euro\u00adpean tech\u00adnol\u00ado\u00adgy com\u00adpa\u00adnies. One can say, with\u00adout exag\u00adger\u00ada\u00adtion, that this is part of an eco\u00adnom\u00adic war on Chi\u00adna \u2013 and a reck\u00adless one at that.<\/span><\/p>\n

Huawei is one of China\u2019s most impor\u00adtant tech\u00adnol\u00ado\u00adgy com\u00adpa\u00adnies and there\u00adfore a prime tar\u00adget in the Trump administration\u2019s effort to slow or stop China\u2019s advance into sev\u00ader\u00adal high-tech\u00adnol\u00ado\u00adgy sec\u00adtors. America\u2019s moti\u00adva\u00adtions in this eco\u00adnom\u00adic war are part\u00adly com\u00admer\u00adcial \u2013 to pro\u00adtect and favour lag\u00adgard U.S. com\u00adpa\u00adnies \u2013 and part\u00adly geopo\u00adlit\u00adi\u00adcal. They cer\u00adtain\u00adly have noth\u00ading to do with uphold\u00ading the inter\u00adna\u00adtion\u00adal rule of law.<\/span><\/p>\n

The U.S. appears to be try\u00ading to tar\u00adget Huawei espe\u00adcial\u00adly because of the company\u2019s suc\u00adcess in mar\u00adket\u00ading cut\u00adting-edge 5G tech\u00adnolo\u00adgies glob\u00adal\u00adly. The U.S. claims the com\u00adpa\u00adny pos\u00ades a spe\u00adcif\u00adic secu\u00adri\u00adty risk through hid\u00adden sur\u00adveil\u00adlance capa\u00adbil\u00adi\u00adties in its hard\u00adware and soft\u00adware. Yet the U.S. gov\u00adern\u00adment has pro\u00advid\u00aded no evi\u00addence for this claim.<\/span><\/p>\n

A recent dia\u00adtribe against Huawei in the Finan\u00adcial Times is reveal\u00ading in this regard. After con\u00adced\u00ading that \u201cyou can\u00adnot have con\u00adcrete proof of inter\u00adfer\u00adence in ICT, unless you are lucky enough to find the nee\u00addle in the haystack,\u201d the author sim\u00adply asserts that \u201cyou don\u2019t take the risk of putting your secu\u00adri\u00adty in the hands of a poten\u00adtial adver\u00adsary.\u201d In oth\u00ader words: While we can\u2019t real\u00adly point to mis\u00adbe\u00adhav\u00adior by Huawei, we should black\u00adlist the com\u00adpa\u00adny nonethe\u00adless.<\/span><\/p>\n

When glob\u00adal trade rules obstruct Mr. Trump\u2019s gang\u00adster tac\u00adtics, then the rules have to go, accord\u00ading to him. U.S. Sec\u00adre\u00adtary of State Mike Pom\u00adpeo admit\u00adted as much last week in Brus\u00adsels: \u201cOur admin\u00adis\u00adtra\u00adtion,\u201d he said, is \u201claw\u00adful\u00adly exit\u00ading or rene\u00adgo\u00adti\u00adat\u00ading out\u00addat\u00aded or harm\u00adful treaties, trade agree\u00adments, and oth\u00ader inter\u00adna\u00adtion\u00adal arrange\u00adments that don\u2019t serve our sov\u00ader\u00adeign inter\u00adests, or the inter\u00adests of our allies.\u201d Yet before it exits these agree\u00adments, the admin\u00adis\u00adtra\u00adtion is trash\u00ading them through reck\u00adless and uni\u00adlat\u00ader\u00adal actions.<\/span><\/p>\n

The unprece\u00addent\u00aded arrest of Ms. Meng is even more provoca\u00adtive because it is based on U.S. extra-ter\u00adri\u00adto\u00adr\u00adi\u00adal sanc\u00adtions \u2013 that is, the claim by the U.S. that it can order oth\u00ader coun\u00adtries to stop trad\u00ading with third par\u00adties such as Cuba or Iran. The U.S. would cer\u00adtain\u00adly not tol\u00ader\u00adate Chi\u00adna or any oth\u00ader coun\u00adtry telling Amer\u00adi\u00adcan com\u00adpa\u00adnies with whom they can or can\u00adnot trade.<\/span><\/p>\n

Sanc\u00adtions regard\u00ading non-nation\u00adal par\u00adties (such as U.S. sanc\u00adtions on a Chi\u00adnese busi\u00adness) should not be enforced by one coun\u00adtry alone, but accord\u00ading to agree\u00adments reached with\u00adin the Unit\u00aded Nations Secu\u00adri\u00adty Coun\u00adcil. In that regard, UN Secu\u00adri\u00adty Coun\u00adcil Res\u00ado\u00adlu\u00adtion 2231 calls on all coun\u00adtries to drop sanc\u00adtions on Iran as part of the 2015 Iran nuclear agree\u00adment. Yet the Unit\u00aded States. \u2013 and only the Unit\u00aded States \u2013 now rejects the Secu\u00adri\u00adty Council\u2019s role in such mat\u00adters. The Trump admin\u00adis\u00adtra\u00adtion, not Huawei or Chi\u00adna, is today\u2019s great\u00adest threat to the inter\u00adna\u00adtion\u00adal rule of law, and there\u00adfore to glob\u00adal peace.<\/span>\u300f<\/span><\/span><\/p>\n
